## Scope

The European Union. The clause names exactly two things this job does every day: allocating tasks based on individual behaviour, personal traits or characteristics, and monitoring and evaluating the performance and behaviour of people in work relationships. Regulation (EU) 2026/1744 (the Digital Omnibus on AI, published 24 July 2026) moved the application of these obligations from 2 August 2026 to 2 December 2027 for systems that are high-risk under Annex III, and to 2 August 2028 for those that are high-risk under Article 6(1) and Annex I; so this is a rule on the books that does not yet apply. High-risk is not prohibition: it brings obligations — risk management, data governance, logging, transparency, human oversight — and this record cites the classification itself, not the detail of that obligation set. It does not say any employer has been penalised under it, and says nothing about jurisdictions outside the EU.

## What this means

When EU legislators drew up the high-risk list, task allocation and performance evaluation were named separately: regulators treat machines doing these two things as consequential enough to legislate for. For a supervisor it turns how the system decided from an internal management question into one with statutory obligations attached — once they apply, from December 2027, after the EU postponed them.

## What it does not show yet

High-risk is not prohibition, and the obligations do not yet apply: the EU pushed them back to December 2027, and they could move again. Nothing here shows any workplace changing practice. The EU only.

Open EUR-Lex's consolidated text of Regulation (EU) 2024/1689 (version of 27 July 2026), find Annex III point 4(b), then Article 113, point (c) "shall apply from: (i) 2 December 2027".
