Where this applies
An EU directive that member states had to transpose by 20 November 2025 and apply from 20 November 2026. Article 18(8) requires member states to ensure that, where a creditworthiness assessment involves automated processing of personal data, the consumer has the right to request and obtain from the creditor human intervention, consisting of the right to a clear explanation of the assessment, to express their own point of view, and to request a review of the assessment and of the decision on granting credit. The recitals add that a review need not lead to credit being granted. The right applies on request; mortgage-secured credit is covered by a different directive, and unsecured credit above EUR 100,000 is outside this one except in limited cases.
What this means
Across the EU, a borrower turned down by an automated assessment will be able to demand that a person explain it, hear them out and review the decision. Someone at the lender has to be able to take that review — the name on the file is being written into law.
What it does not yet show
A right on request that applies from November 2026; it does not say who reviews, how often borrowers ask, or whether reviews change outcomes.
