California, United States. The statute says any unlicensed person employed by a clinical laboratory to perform the duties it describes shall hold a valid certificate as a certified phlebotomy technician, working under a licensed physician, registered nurse or other licensee, whose supervisor must determine that the technician is competent to perform venipuncture or skin puncture before the first blood withdrawal and annually after, and that the technician collects blood with devices approved by the facility and the FDA. Read as amended effective 17 September 2025. It says which people may draw blood; it is silent on whether a supervised robotic device is lawful.
